GDPR now embedded in Microsoft Product Terms and Online Services Terms
To comply with the new EU General Data Protection Regulation, which comes into effect May 25th 2018, Microsoft has updated the September 2017 editions of the Product Terms and Online Services Terms.
The Microsoft Product Terms are part of any volume licensing agreement a customer signs with Microsoft. In the September edition of these Product Terms, Microsoft has added a new article to the ‘Universal License Terms’:
To the extent Microsoft is a processor or subprocessor of personal data in connection with a Product or the provision of Professional Services, Microsoft makes the commitments in the European Union General Data Protection Regulation Terms in Attachment 4 of the Online Services Terms to all customers effective May 25, 2018.
All Microsoft cloud subscriptions, like Office 365, Azure, Windows, Dynamics 365, Microsoft 365, Enterprise Mobility and Security (EMS), are subject to the Online Services Terms (OST). In the September 2017 edition of the OST Microsoft has added ‘Attachment 4’ where it describes how the Microsoft online services will comply with the new European Union General Data Protection Regulation.
